1. Acceptance of Terms
By accessing or using the Precision Physique application ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms constitute a legally binding agreement between you and Precision Physique AI Pty Ltd (ACN pending), a company incorporated in New South Wales, Australia.
2. Service Description
Precision Physique provides an AI-powered fitness and nutrition coaching platform. The Service includes personalised workout plan generation, diet plan creation, progress tracking, and optional personal training session bookings. AI-generated content is produced using Anthropic's Claude language model.
3. Eligibility
You must be at least 18 years of age to use this Service. By creating an account, you represent that you are 18 or older. Minors under 18 may only use the Service with verified parental or guardian consent and supervision.
4. Billing and Payments
Subscription fees are billed monthly in advance in Australian Dollars (AUD). All payments are processed securely via Stripe. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. Refunds are provided in accordance with the Australian Consumer Law (ACL). No refunds are provided for partial months.
5. AI-Generated Content
Workout and nutrition plans are generated by artificial intelligence and are intended for general informational purposes only. AI-generated content does not constitute professional medical, nutritional, or fitness advice. Precision Physique does not guarantee the accuracy, completeness, or suitability of AI-generated content for your specific circumstances.
Before starting any new exercise programme or making significant changes to your diet, you should consult a qualified healthcare professional, particularly if you have any pre-existing medical conditions or injuries.
6. Personal Training Sessions
PT session bookings are subject to trainer availability and the specific terms communicated at time of booking. Sessions cancelled with less than 24 hours notice may be forfeited. Precision Physique trainers hold relevant Australian fitness qualifications and current first aid certifications.
7. User Responsibilities
You are responsible for providing accurate health and fitness information. You must disclose any medical conditions, injuries, or contraindications that may affect safe participation in exercise. You agree to use the Service only for lawful purposes and not to misuse, abuse, or attempt to circumvent any Service limitations.
8. Limitation of Liability
To the maximum extent permitted by Australian law, Precision Physique AI Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the amount you paid in the 3 months preceding the claim.
9. Intellectual Property
All content, branding, and software comprising the Service are the property of Precision Physique AI Pty Ltd or its licensors. You may not reproduce, distribute, or create derivative works without express written permission. AI-generated plans are provided for your personal use only.
10. Termination
Either party may terminate the Service agreement at any time. You may cancel your subscription via the app settings. We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose safety risks to themselves or others.
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales. Nothing in these terms affects your rights under the Australian Consumer Law.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before changes take effect. Continued use of the Service after changes constitutes acceptance of the updated terms.
