1. Acceptance of Terms
By accessing or using the Precision Physique application ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms constitute a legally binding agreement between you and Precision AI Labs Pty Ltd (ACN 699 956 842 · ABN 67 699 956 842), a company registered in New South Wales, Australia.
2. Service Description
Precision Physique provides an AI-powered fitness and nutrition coaching platform. The Service includes personalised workout plan generation, nutrition targets and food logging, and progress tracking. Coaching and personal training are not sold in this version of the app; you can join a waitlist for them. AI-generated content is produced by third-party AI models.
3. Eligibility
You must be at least 18 years of age to use this Service. By creating an account, you represent that you are 18 or older.
4. Billing and Payments
Subscription fees are charged in advance in Australian Dollars (AUD). Subscriptions bought in the app are sold by Apple (App Store) or Google (Google Play) and billed to your Apple ID or Google account. They renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You can manage or cancel a subscription in your Apple ID or Google Play subscription settings; deleting the app does not cancel it. Refunds for store purchases are handled by Apple or Google under their policies; nothing in these Terms limits your rights under the Australian Consumer Law. Stripe is used only for in-person coaching, when we offer it.
5. AI-Generated Content
Workout and nutrition plans are generated by artificial intelligence and are intended for general informational purposes only. AI-generated content does not constitute professional medical, nutritional, or fitness advice. Precision Physique does not guarantee the accuracy, completeness, or suitability of AI-generated content for your specific circumstances.
Before starting any new exercise programme or making significant changes to your diet, you should consult a qualified healthcare professional, particularly if you have any pre-existing medical conditions or injuries.
Food photo analysis is for personal use and has a fair daily limit; its nutrition estimates are approximate and you can adjust them before saving.
6. Personal Training & Coaching Services
Coaching and personal training services are not currently offered through the app. If they are introduced, their terms will be set out before purchase.
When coaching is offered, nutrition guidance provided by coaches on Hybrid and Personal Training subscription tiers constitutes general performance nutrition coaching for healthy adults, aligned with the Australian Dietary Guidelines. Coach-provided dietary guidance does not constitute clinical dietetics, medical nutrition therapy, or a substitute for advice from an Accredited Practising Dietitian (APD) or medical professional. Clients with clinical health conditions are assessed via the in-app Nutrition Screening process and referred to an APD.
AI-generated meal examples and macro targets shown in the app are automated general fitness-nutrition guidance for healthy adults. Portion sizes are illustrative of macro targets and do not constitute a meal plan prescribed by a dietitian, clinical dietetics, or medical nutrition therapy. For a prescribed meal plan, consult an Accredited Practising Dietitian.
7. User Responsibilities
You are responsible for providing accurate health and fitness information. You must disclose any medical conditions, injuries, or contraindications that may affect safe participation in exercise. You agree to use the Service only for lawful purposes and not to misuse, abuse, or attempt to circumvent any Service limitations.
8. Limitation of Liability
To the maximum extent permitted by Australian law, Precision AI Labs Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the amount you paid in the 3 months preceding the claim.
9. Intellectual Property
All content, branding, and software comprising the Service are the property of Precision AI Labs Pty Ltd or its licensors. You may not reproduce, distribute, or create derivative works without express written permission. AI-generated plans are provided for your personal use only.
10. Termination
Either party may terminate the Service agreement at any time. You can cancel a subscription in your Apple ID or Google Play subscription settings, and delete your account in the app's settings. We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose safety risks to themselves or others.
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales. Nothing in these terms affects your rights under the Australian Consumer Law.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before changes take effect. Continued use of the Service after changes constitutes acceptance of the updated terms.
